Extinction of domain is applied to the assets of relatives and friends of alias Otoniel

The forcefulness of the probative material presented by a prosecutor from the Specialized Directorate for the Extinction of Domain Rights, allowed a judge to declare the extinction of domain over 48 assets; between furniture, real estate and bank accounts; owned by Juan de Dios Úsuga Orrego, father of Dairo Antonio Úsuga David, alias Otoniel; and various members of his family and people close to him.

Assets extinguished in favor of the State, whose value is close to 80,000 million pesosappear in the name of Ana Celsa David de Úsuga, Ana Dilma Úsuga David, Yira Úsuga Úsuga, Ana María Gómez David, Carmen Cardelia Castellanos Coava, Didier Geovanny Grisales Sarmiento, Juan de Dios Úsuga Orrego, Joaquín Orlando Gómez Durango, Guillermo de Jesús Granada Arcila, Lody Amparo David Sánchez, Julián Enrique Uribe Villamizar and Sebastián Mauricio Uribe Villamizar.

The prosecution proved that the goods had been acquired with money from the illegal actions carried out by the Clan del Golfo and that their owners lent their names to give the appearance of legality to them.

The criminal proceedings against relatives of alias Otoniel

The extinction actions originated after advance criminal proceedings against Nini Johana Úsuga David, alias La Negra; Rafael Uribe Nieto, Walter de Jesús Castrillón Jaramillo and Medardo Peña Bautista, who They were captured by the National Police.

At the time of their arrest, these people 8,000 million pesos in cash were seized from them, which were found in coves discovered on farms and Medellin apartments. Said sum, apparently, belonged to the Clan del Golfo commanded by Dairo Antonio Úsuga David, alias Otoniel.

In developing these actions, James David Hernández, Rafael Uribe Nieto, Joaquín Orlando Gómez Durango and Harlinson Úsuga Úsuga were also linked; alleged members of a criminal organization.

The Prosecutor’s Office charged them with the crimes of conspiracy to commit aggravated crime, money laundering; manufacture, trafficking and possession of firearms and ammunition; and illicit enrichment of individuals, among others.

As a consequence of this criminal action, A domain forfeiture prosecutor carried out a search of personal and real estate belonging to members of the Úsuga David family, as well as third parties who increased their assets as a result of the illegal activities carried out by the Clan del Golfo. Against this decision proceed the appeal.

Other sentences of extinction of domain to alias Otoniel

On February 14, 2017, a specialized judge from Antioquia, by court ruling, decreed the extinction of the right of domain over 16 assets by Nini Jhoana Úsuga David, Rafael Uribe Nieto, Walter de Jesús Castrillón and Medardo Peña Bautista. It involved thirteen properties, two automobiles and a savings account.

In another ruling issued by the first court of Antioquia on August 31, 2022, the extinction of domain over 47 assets that were part of the family assets of this same family nucleus was decreed. It involved 33 properties, six automobiles and eight bank accounts.
