The Qinghai Provincial Higher People’s Court Reveals 9,678 Labor Dispute Cases Accepted in the Past Three Years

Qinghai Rule of Law News (Qinghai Rule of Law News·Fayan reporter Guo Jia) – In a recent press conference held by the Qinghai Provincial Higher People’s Court on April 29, it was disclosed that people’s courts at all levels in Qinghai Province have accepted a total of 9,678 labor dispute cases from 2021 to 2023. These cases, categorized as people’s livelihood cases, encompass a variety of issues including irregular employment, group cases, prolonged duration, policy application problems, and disputes arising from new forms of employment.

Labor disputes have become increasingly intricate in recent years, with workers demonstrating a heightened awareness of their rights. In response to the evolving judicial needs of workers, people’s courts have ramped up efforts to protect labor rights, address wage arrears in compliance with the law, enhance judicial policies related to new employment forms, and facilitate avenues for workers to defend their legitimate rights.

To ensure consistent application of laws and promote a modernized trial concept, people’s courts throughout the province distribute typical cases and adjudication rules through the “Civil Trial Guidance Special Issue.” This publication serves as a guide for issues requiring a uniform interpretation of the law in trial practice, emphasizing a standardized approach to similar cases for equitable rulings. Additionally, courts maintain close communication with human resources and social security departments, establishing a collaborative mechanism between government entities and institutions to effectively resolve labor disputes.

In combatting wage-related grievances of migrant workers, courts actively engage in government-led special initiatives, streamline case filings in specific fields, and swiftly safeguard the lawful rights of migrant workers. Efforts are also made to differentiate between complex and straightforward cases to expedite trial processes and crackdown on malicious wage defaults.

In light of the burgeoning platform economy, the Provincial Higher People’s Court is diligently implementing the “Guiding Opinions on Safeguarding the Labor Security Rights and Interests of Workers in New Employment Forms” in conjunction with the Qinghai Provincial Department of Human Resources and Social Security. By aligning with the implementation opinions of Qinghai Province, the court aims to enhance judicial policies concerning labor disputes arising from novel employment structures.
