His father was also a victim of the accident, but managed to recover more quickly. The person responsible was convicted in the first instance, but apparently economic power and corruption weighed more and two appeals judges decided to annul the first instance sentence and ordered a new oral and public trial.
For lawyer Derlis Martínez, conventional representative of the family, the damage suffered by the victims and the relatives themselves is irreparable. He explained that everyone is waiting for justice, and for the person responsible to pay for what he did. “This child lost his school, he has already undergone more than 15 reconstructive surgeries and other medical interventions will follow, the actions of our magistrates are truly regrettable at times,” he indicated.
The legal professional stated what hurts most for everyone is that the people closest to the person primarily responsible for the incident are the ones who always mention that they had to pay a large sum of money for this to happen. “I cannot particularly accuse the members of the court, but today it is practically an open secret that money was spent so that the ruling came out against us, at least this is clear from the people close to the Galhera family, whose son was the driver of the vehicle that was involved in the accident,” he said.
He recalled that the expert’s own expertise had determined that the accident was impulse, that is to say that at no time did the driver (Paulo Galhera Bardigon) at least manage to brake to avoid colliding with the rear of the car in which Elvio Duarte and Néstor were traveling. , father and son.

BACKGROUND
The accident occurred at night on November 27, 2023 when it was around 11 p.m., on the new Graneros del Sur route, father and son were traveling calmly aboard a Toyota Premio brand car heading to Presidente Franco. In the town of Los Cedrales they were violently run over by a Toyota Fortuner truck, driven by Paulo Galhera Bardigon accompanied by four other people.
The impact was so brutal that it threw the smaller vehicle to the side of the road. The vehicle practically exploded at the moment, the father of the conscious boy was able to save his son from death, rescuing him with serious burns.
The truck also overturned and due to the protection system it had, they only suffered bruises. The two victims were later transferred to a healthcare center, the child remained in the ICU for 59 days in the country’s capital.
