The Ministry of Health sued the EPSs, including Sanitas, Nueva EPS, Salud Total and Sura, for alleged violations of access to social security.
On this Sunday morning, the Colombian Ministry of Health confirmed that it filed a legal action against 21 EPS, accusing them of violating access to social health security and its effective and timely provision. Among the EPSs being sued are recognized entities such as Sanitas, Nueva EPS, Salud Total and Sura, among others.
In the Ministry’s demand, it states that these entities did not comply with the obligation to maintain technical reserves: “In the lawsuit filed, it is clarified that according to the Supersalud report, evaluation of compliance with the indicators of minimum capital, adequate assets and technical reserve investment regime-September 2023, calculated with the information sent by the EPSs themselves, it is emphasized ( …) non-compliance with technical reserves by the aforementioned EPS”, says the Ministry in a short communication.

Technical reserves are constituted as financial support that should allow EPSs to fulfill their responsibilities regarding the medical care of members. These reserves must be calculated considering factors such as the projection of demand for health services, medical costs, fluctuations in the utilization of services and other financial risks.
Ana María Vesga, director of Acemi (the EPS union of the contributory regime), responded to the judicial action through the social network X, highlighting the union’s previous efforts to discuss the situation.

Through X, the lawyer wrote: «In defense of dialogue, Acemi has presented a proposal for the EPS to become Managers, it has promoted technical tables to explain the insufficiency of the UPC, it has requested spaces to delve into the analysis of technical reserves. The Ministry appeals to inaction and now to judicial actions and denies the health system the technical dialogue it requires. Meanwhile, those affected are millions of Colombians who are beginning to see that the explicit crisis is real.”
For his part, the Representative to the Chamber for Valle del Cauca, Víctor Manuel Salcedo, pointed out that with this action, the Government seeks to end the health system.
