Pedestrian was not driving while intoxicated: the president of the APU was acquitted

UDINE. The president of the APU Old Wild West basketball, Alessandro Pedone, was acquitted of the charge of driving under the influence of alcohol because the fact does not exist. The monochrome judge Carla Missera read the device yesterday morning, in the courtroom named after judges Falcone and Borsellino on the first floor of the courthouse, thus accepting the thesis of the entrepreneur’s defenders, the lawyers Luca Ponti and Antonio Rigo. The prosecutor, for his part, had requested a two-month sentence and a 1,500 euro fine.

On 24 November 2019 Pedone was stopped in piazzale XXVI Luglio while he was driving his car. The alcohol test he had undergone had shown an alcohol level (0.8 grams of alcohol per liter of blood) above the legal limit (0.5).

From the very first moment, the president of the APU had contested the result of the “balloon”, explaining that the result had been altered by taking bronchenol-based drugs, which he had been taking for a few days to treat an annoying form of tracheitis. Around this point, the defensive line adopted by the lawyers Ponti and Rigo developed, who during the trial demonstrated how the type of medicine taken by Pedone indicated from the leaflet as a possible side effect the positivity to any test for the identification of the presence of alcohol in the blood.

A thesis accepted by the judge, who acquitted Pedone, not considering him guilty of the crime of driving under the influence of alcohol. The Friulian entrepreneur had opposed the withdrawal of the license from the first hour, foreseen in these cases: the Prefecture, which is responsible for expressing itself on the matter, has suspended the trial, pending the ruling of the court. Yesterday’s ruling will effectively avoid the withdrawal of the driving license of the president of the Old Wild West.
