The Attorney General’s Office instituted popular action to protect the collective right of access to public services, after receiving a complaint from a citizen.
A lawsuit filed by the Attorney General’s Office before the Administrative Court of Cauca, protected the collective right related to access to public services since its provision is efficient and timely for the inhabitants of Mercaderes, Cauca.
This protection was requested through a popular action established by the Attorney General’s Office Provincial of Popayán against the municipality, the Caucana Public Services Company Emcaservicios SA ESP and the Public Services Provider Company Empomer SA ESP, after receiving a complaint from a citizen about the lack of drinkability of the water.
As a basis for its action, the control entity stated that the municipal Health Secretariat carried out a water quality test for human consumption that showed results outside the standard for residual free chlorine and turbidityAdditionally, he pointed out that Empomer SA ESP expressed the need to improve the water treatment and purification process.
The court accepted the arguments of the Public Ministry and ruled that the prosecuted entities must carry out the necessary steps and actions to guarantee that the water supply in the municipal seat, coming from the treatment plant and intake that is supplied from the Hato Viejo River, meets the chemical health standards required to guarantee the drinkability and suitability of the vital liquid.
Finally, the first instance court ruling ordered the constitution of a Compliance Verification Committee with the sentence to monitor its execution.
