From the Municipal Office we are pleased to inform you that on January 25, 2024, the Territorial Development Finance Company, FINDETER, published through the Electronic Public Procurement System the public call for procurement that would have as its objective “THE REVIEW, ADJUSTMENT AND COMPLEMENTATION OF STUDIES AND DESIGNS, DEMOLITION AND CONSTRUCTION OF THE SAN JOSÉ EDUCATIONAL INSTITUTION – MAIN HEADQUARTERS LOCATED IN THE MUNICIPALITY OF SAN JOSÉ DEL PALMAR, DEPARTMENT OF CHOCÓ” for a total value of “THIRTEEN BILLION FIVE HUNDRED AND EIGHTY-SIX MILLION THREE HUNDRED AND FIFTY-SEVEN THOUSAND SIX HUNDRED AND FOURTEEN PESOS ($ 13,586,357,614.00) M/CTE”.
In this selection process, the proponent must be chosen that meets the qualifying requirements, such as legal capacity and conditions of experience, financial capacity, among others, and that has the highest score in the final evaluation report that must be published on February 22, 2024 with the indication of the selected offer.
The execution of this contract, according to previous studies, will have two stages:
1. The review, adjustment and complementation of studies and designs, obtaining permits and/or construction licenses in the modalities that are required, which has a period of three (3) months.
2. Demolition and construction that would have a period of nine (9) months.
Likewise, the hiring of the auditor was called for up to a value of NINE HUNDRED AND SIXTY-TWO MILLION TWO HUNDRED AND EIGHTY-THREE THOUSAND NINETY PESOS ($962,283,090) M/CTE.
It is important to remember that, in accordance with the contractual management reports of Findeter SA and reports from the Departmental Education Secretariat (sent to the guardianship judge and which have been published on our page), the Government of Chocó to comply with the Sentence of Tutela T-045 of 2023 of the Constitutional Court, where the Municipal Ombudsman is the plaintiff, prioritized this educational headquarters (despite not being on the list of prioritized locations) over several of the department’s headquarters that also present similar needs, so that the Ministry of Education together with Findeter SA could invest resources up to a maximum amount of FIFTEEN BILLION PESOS (15,000,000,000) M/CTE.
It should be noted that, as is our responsibility, after verifying the aforementioned prioritization, we have made written requests to the Ministry of National Education as supervisor of the macro inter-administrative contract (from which the resources come to open this new contracting process). and Findeter SA for the purposes of carrying out all the actions to convene it, this due to the delays in the schedule that were confirmed by the Ministry in the supervision reports as a concern.
Likewise, the Municipal Ombudsman highlights that this is an achievement of the people of Palma and that is why the hard work that the students and parents of IE San José have done for years to ensure its execution is also highlighted.
The impact of the municipal mayor’s office in the process is also highlighted with the presentation of studies and designs (which according to Findeter in the contractual management report for the month of August 2023 require adjustment and complementation as they are incomplete), the Government of Chocó when proposing a definitive solution through prioritization, and even the interest of the municipal council who notified the Ombudsman at the time so that actions could be taken regarding the state of the headquarters’ infrastructure.
However, a call is made to the educational community to more decisively accompany the Public Ministry to oversee this process, influencing the Dialogue Table created in compliance with Sentence T-045 of 2023 of the Constitutional Court. to be able to materialize this definitive solution; but also, so that the obligated entities implement a Contingency Plan while the demolition and construction works are carried out.
This Dialogue Table must meet periodically to monitor compliance with the ruling and make proposals to ensure it, being composed of the Government of Chocó (which presides over it) through the Departmental Education Secretariat, the Mayor’s Office of San José del Palmar , the Rectorate of the Educational Institution, representatives of the parents, students and the Office. Municipal that also requested the Government of Chocó that Findeter SA make a permanent presence of this table as it is the entity that will execute the resources and supervise the work.
