Supreme Court of Cassation | Civil jurisprudence detail

The United Civil Sections – ruling on the conflict of jurisprudence regarding the possibility of establishing and recognizing parking easements – affirmed the following principle:

«In terms of easements, the scheme provided for by art. 1027 cc does not preclude the establishment, by agreement, of an easement relating to the parking of a vehicle on someone else’s land provided that, based on the examination of the title and a concrete verification of the factual situation, this right appears to have been attributed as advantage in favor of another fund for its best use and provided that the requirements of real law and in particular the location exist”.
