The former president of Ivat acquitted of the charge of tax damage

Enrico Bonomi was accused of having benefited an artisan cooperative of which he is a director

The Court of Auditors of the Aosta Valley acquitted Ermanno Bonomi of the accusation of having caused tax damage of over 9 thousand euros to Ivat, the Valdostano Institute of Tradition Crafts of which he was president.

According to the regional accounting prosecutor, Bonomi had exploited his position as president of the Institut and as director of Derby Legno Ceramica to increase the latter’s business volume with an “anomalous increase in contributions” in 2017 as part of the operations marketing of artisanal products that Ivat can carry out on behalf of third parties.

The jurisdictional section of the Aosta Valley did not accept the accusation’s thesis. The president of Ivat has no decision-making powers, the judges point out, and “it is not known (…) what conduct the defendant Bonomi would have put in place, in his capacity as Ivat president, in relation to the commercial relations maintained with the Derby Legno Ceramica artisan cooperative society ». The judges also point out that “in the face of an increase in expenditure incurred, Ivat has also purchased goods which it is not known whether it has been sold or not”. To prove his accusations “the Prosecutor should have investigated the volume of sales by Ivat in the following years and this in order to demonstrate the actual uselessness of the expenditure incurred”.

The accusation of the accounting power of attorney was rejected “for the evident non-configurability of a tax damage and for the non-existence of an unlawful conduct attributable” to Bonomi, as stated in the sentence published in recent days.
