UDINE. Fiorentina- Udinese must be played. The sports judge of Serie A, Gerardo Mastrandrea, on Friday 18 February decided that the match of the first day of return, originally scheduled for last 6 January but not played due to the non-presentation at the Artemio Franchi stadium in Florence of the Friulian bianconeri, stopped by ‘Udinese health company due to Covid cases in the team group, must be recovered.
“Having regard to the peculiarities of the present case, it is the opinion of this Judge that the final disqualifying device of the provision of the Friulian ASL can validly constitute a case of force majeure, declined under the modalities of the exemption per factum principis – writes Mastrandrea to justify the decision -. To this it must be added that no particular charge, even in terms of lack of perfect diligence or, on the contrary, of causal sharing, can be attributed to the Udinese company, in the face of such a type of ASL provision (currently valid and effective ) and, last but not least, the conduct held by the same company in this case “.
