Chancellor Leyva Urges President to Name Replacement Amid Legal Battle

Chancellor Leyva is hopeful that the President will name his replacement before facing the sanctions of the Attorney General’s Office. As the President is responsible for nominating the Ministry of Foreign Affairs, Leyva emphasizes the need for a successor to guarantee the service and operation of the ministry.

Leyva’s defense has presented a petition to the Attorney General’s Office, expressing concerns over the potential investigation for abandonment of office and failure to fulfill functional duties if a replacement is not appointed. The deputy attorney general has criticized Leyva for continuing to exercise his functions despite the suspension, which has been deemed as a risk to the Constitution and the law.

Moreover, the Disciplinary Chamber of the Attorney General’s Office suspended the minister for three months and opened a charge sheet for alleged irregularities. This decision has raised questions about the adherence to the political charter and the laws, with concerns that the actions of democratically elected authorities are undermining the legal order.

The defense of Leyva has requested a review of the suspension, claiming it to be disproportionate. They have also requested the attorney in charge to declare herself prevented from studying the appeal due to prejudgments.

The Attorney General’s Office has emphasized its responsibility to defend the legal system and ensure compliance by all public servants. The ongoing legal battle raises questions about the adherence to the constitution and the laws, with implications for the rule of law and institutionality.
