MILANO – The Council of Ministers has decided to update itself in the afternoon for the approval of the final 248 billion National Recovery and Resilience Plan which must receive the green light before being transmitted to the European Commission. There is still a need for a discussion between the Government and the Regions on the decree that contains the 30 billion national complementary fund attached to the Recovery plan: a step that would have been requested in the CDM by the Minister for Regional Affairs Gelmini, without political controversy.
Green light, however, to the decree law with the extension of some measures such as simplified smart working, the validity of identity documents and the budgets of local authorities (May 31). Also including more time to exercise golden power in sectors of strategic importance (until 31 December) while the deadline for the preparation of the financial statements of the Chambers of Commerce has been postponed to 30 June.
According to the draft circulated before the start of the CDM, the decree on extensions consists of eleven articles, starting with smart working in the Pa. On this point, the obligation to make one in two public employees work in smart working, neither during the emergency nor with the adoption of the Pola, the organizational plans for agile work. According to the draft, smart working can continue in derogation until the definition of the new rules with the national contract (government sources report that it will have to be regulated by the end of September) and in any case no later than the end of the year. But there will be no 50% constraint. The 60% limit indicated in the Pola also jumps, while the minimum threshold falls from 30% to 15% in the event of failure to adopt the organizational plans.
Among other measures, action is taken on driving licenses: for applications for the driving license presented in 2020, the theory test can be carried out by 31 December 2021 while for those presented from 1 January 2021 and up to the date of cessation of the state of emergency, or 31 July, this test will not will be required.
Instead comes the extension of the terms of validity of identification and identity documents. The draft of the extension law decree provides that the deadline currently set at 30 April, already the result of a rule that extended the validity of all documents, is postponed for another 5 months to 30 September.
Among the areas affected by the extensions, the railway companies they will have until May 15 for the reporting necessary to obtain the benefits to compensate for the losses suffered due to the Covid emergency and the Ministry of Infrastructure will have until June 15, 2021 to issue the ministerial decree with the allocation of resources. For the cruise ships registered in the International Register, notwithstanding the regulations in force, they will be able to carry out cabotage services, until 31 December 2021, subject to an agreement to be stipulated between the employers and trade union associations signing the national collective bargaining agreement for the private sector of the shipping industry. Finally, under the heading of prisons Urgent anti-Covid measures for prisons are extended until July 31, the current deadline for the end of the state of emergency.
Some issues remain pending from the draft, such as new stop to tax bills frozen until tomorrow by emergency measures. The government is considering further postponement at the end of July, with the end of the state of emergency, but the financial space is limited. The previous fiscal extension has already cost the state coffers 500 million euros and a new intervention could require even more. The measure could eventually be included in the Sostegni bis decree which should be launched next week. The knot of the extension of the bathing concessions, which does not appear in the text that was drafted at the executive meeting.
