Sohu Entertainment News According to the Qichacha APP, recently, the People’s Court of Fengtai District, Beijing announced a case of dispute over portrait rights. The plaintiff, Sun Li, claimed that in April 2021, it was found that the defendant Huadan Company had printed her portrait and name on the outer packaging and product brochures of “Banlaiya” brand cosmetics without her authorization, and posted them in the shopping mall counters and online stores. Selling products with his likeness and name, the plaintiff sent a letter after discovering the infringement, requesting to immediately stop the infringement, apologize and compensate for the loss, but the defendant refused to perform, so he sued to the court.
The court held that Huadan Company had not fulfilled its prudential duty and withdrawn the infringing photos after receiving the lawyer’s letter sent by Sun Li. Its fault was obvious, and it should be determined that Huadan Company had infringed on Sun Li’s portrait rights. The result of the judgment is that Huadan Company immediately stopped the infringement, apologized to Sun Li and compensated 500,000 yuan for the use of the portrait and 5,380 yuan for reasonable expenses for rights protection.Return to Sohu, see more
