Our column dedicated to the new CCNL continues, with in-depth information, dealing with specific issues of interest to all workers in the health sector. All information will be available in the NURSES – REGULATIONS section. We will talk about the methods of assignment, requirements and revocation of the assignments

The requisites required for the assignment of professional duties, in relation to the different areas and roles, are the following:

a) for the area of ​​health professionals and officials:

  • a1) to newly hired staff and to staff already in service who are not recipients of a medium or high complexity assignment, an assignment of basic complexity is automatically recognized;
  • a2) the assignment of medium and high complexity, in relation to the role to which it belongs, includes the following requirements:

Requirements:

  • Appointment of “specialist professional”: possession of the first level master’s degree for specialist functions in accordance with the provisions of art. 6 of Law no. 43/2006, positive evaluation of individual performance with reference to the last two years or in any case the last two evaluations available in chronological order, if it was not possible to carry out the evaluation due to absence from the service in relation to one of the years and absence of measures disciplinary in the last two years above the fine;
  • Assignment of “expert professional”: acquisition of advanced skills through complementary training courses identified by the Company or Entity with specific regulations, together with the possession of a three-year professional experience, positive evaluation of individual performance with reference to the last two years or in any case the last two evaluations available in chronological order , if it was not possible to carry out the assessment due to absence from the service in relation to one of the annuities and absence of disciplinary measures in the last two years exceeding the fine;
  • Assignment of “professional function”: 5 years of professional experience gained in the membership profile, positive assessment of individual performance with reference to the last two years or in any case the last two assessments available in chronological order, if it was not possible to carry out the assessment due to absence from the service in relation to one of the annuities and the absence of disciplinary measures in the last two years exceeding the fine.

Conferment, duration, renewal and revocation of organizational and professional duties

To staff belonging to the area of ​​health professionals and officials:

a) For newly hired personnel and for personnel not recipients of a medium or high complexity assignment, a job of professional function of basic complexity is assigned;

b) Upon maturity of the requirements, a position in an organizational or professional function of medium or high complexity. Without prejudice to the annual evaluations of positive individual performance in the last two years or in any case the last two evaluations available in chronological order, if it was not possible to carry out the evaluation due to absence from the service in relation to one of the years and the absence of measures disciplinary in the last two years above the fine, the requisite required, except for the provisions of art. 35 (Transitional rule on the system of assignments) for the assignment of the assignments of the organizational function, is the possession of one of the following requisites:

  • university degree or equivalent qualification and at least five years of professional experience in the profile to which they belong;
  • for the sole coordination function, which represents a type of assignment in the context of the organizational function assignments for the personnel of the health role, the possession of the requisites referred to in art. 6, paragraphs 4 and 5 of the law n. 43/2006.

Methods of assigning tasks for the Health Authorities

Companies and Bodies, in compliance with the provisions and national and regional legislation in force, as well as after comparison pursuant to art. 6 paragraph 3, lett. d) (Comparison), formulate the criteria for the assignment in advance and revocation of the assignments. The Companies and Bodies also provide for the description of each assignment and, with the exclusion of basic professional positions, the definition of the selection criteria. The selection criteria are reported in the selection notice.

In selection the weighted evaluation of all qualifications presented by candidates must be envisaged, in relation to the professional peculiarities that characterize the areas, fields and profiles and in particular a balanced weight must be attributed to professional experience, to the qualification (s), to the other cultural and professional qualifications, to refresher courses and professional qualification, thus excluding generalized automatisms based on seniority of service.

As part of the selection for positions in an organizational or professional function, the master’s degree or specialist degree, the first or second level university master’s degree or any training courses must be valued..

Function assignments are assigned by the Company or Entity on the basis of the results of the selection among the requests to participate (with the exclusion of basic professional positions), with a written and motivated provision that contains the contents including, in particular, the description of the lines of activity, the criteria, the evaluation procedure, the salary and the general objectives to be achieved.

The duties of the personnel of this area are financed with the resources of the fund pursuant to art. 102 (Provision for Assignments).

Revocation of offices

The employee who is assigned a function assignment carries out, where foreseen, a ready availability service. In this case, the hours made in the case of a call are remunerated according to art. 44 paragraphs 6 and 7 (see article NurseTimes “Service of immediate availability”).

The duties of function, with the exclusion of basic professional positions, they can be renewed after a positive evaluation at the end of the assignment and absence of disciplinary measures in the last due years in excess of the fine.

If, at the end of the assignment, the evaluation is negative or there is the presence of disciplinary measures in the last two years exceeding the fine, it is provided (for personnel belonging to the area of ​​health professionals and officials), with the exclusion of the basic professional functions the assignment of a professional assignment of basic complexity.

There is no provision for the awarding of remuneration in the year of non-renewal of the medium and high complexity assignment and for that of basic complexity in the year of the negative evaluation.

The revocation can be ordered before the expiry of the assignment, with the exclusion of basic professional positions, by effect:

a) of the negative evaluation annual pursuant to art. 34 (Evaluation of positions and functions);

b) following disciplinary proceedings concluded with the imposition of a sanction greater than the fine.

The revocation takes place with a written and motivated deed and involves for personnel belonging to the area of ​​health professionals and officials the guarantee of the only professional assignment of basic complexity.

There is no provision for the payment of bonuses in the year of revocation of the appointment.

If the Company or Entity, following reorganization processes deriving from the modification of the company deedmust revoke the assignment before its expiry or at the expiration itself, the employee remains in the area, role and profile he belongs to, reacquiring the functions of the same profile with payment of the related salary. To staff belonging to the area of ​​health professionals and officials other function assignments also of a lower economic value may be entrusted but not below the value of the indemnityat of function of fixed part corresponding to complexityat of the revoked office; the personnel with basic professional duties will exerciseat the assignment within the newly assigned corporate structure.

If the employee, belonging to the area of ​​health professionals and officials, already holder of a position of medium or high complexity, as a result of the relative revocation returns to the holder of a position of professional function of basic complexity, the fixed part is guaranteed of the function allowance corresponding to the complexity range of the revoked position until the natural expiry of the previously assigned position.

If the employee, belonging to the operators area and the assistants area, already holder of a professional role, as a result of the revocation is not the recipient of another assignment, provided that he has matured at least 15 continuous years of assignments with end-of-assignment assessments as well as annual evaluations of positive individual performance in the last two years or in any case the last two evaluations available in chronological order, if it was not possible to carry out the evaluation due to absence from the service in relation to one of the annuities, he is entitled to a check non-reabsorbable personnel for an amount equal to the value of a differential of the area in which they are employed, from the fund referred to in art. 102 (Fund for assignments).

The task of a low, medium or high complexity professional function falls within the calculation of the 15 years. During the period of stay in the post, the employee can participate in the selections for economic progression within the area to which he belongs if he is in possession of the relative requisites.
