TURIN. What happens now? Yesterday the question began to circulate in the Municipality after the decision of the Court of Appeal to reject the appeal presented by two mothers who asked to recognize the surname of both of their daughters. In the same procedure, the City had appeared in court to defend what is considered a conquest on the front of rights. For the moment the line of caution prevails: the municipal advocacy has been consulted for “legal insights”, requested by the mayor Stefano Lo Russo and the councilor for rights Jacopo Rosatelli. Until that moment it is very likely that the registrations in the Registry of children of same-parent couples are frozen.
The political battle
According to legal experts, however, the decision of the Turin Court of Appeal is not a tombstone on the issue. Technically, therefore, the judges’ decision concerns only a single case and would have no effect on future registrations, unless someone challenges them. A not so probable hypothesis. For those already built in the past, about eighty, there should be no problems of any kind.
The battle now moves to the political level, with the firm will announced by the Lo Russo junta to continue on the path traced by the Appendino administration. She was the first mayor in Italy, in April 2018, to register the child of a same-parent couple in the registry office: Nicolò Pietro, son of the current councilor Chiara Foglietta and his partner, who is now four years old.

After the first decree of the Court, Mayor Lo Russo had launched an appeal to Parliament to finally fill a legislative vacuum, thus allowing citizens to have their rights recognized “without being ashamed or having to resort to subterfuge”. “It is intolerable – he thundered – that in 2022 there is no clear rule on this issue, left on the shoulders of municipalities and courts”. Yesterday he reiterated the message, in a joint note with the commissioner Rosatelli: “It is necessary to recognize the parenting of same-sex couples in the supreme interest of minors to grow up in a family with full rights and duties”. And he spoke, in no uncertain terms, of discrimination of certain family laws, asking the Legislator to “finally do his part to reform them. The company is ready, politics is so too ».
The outburst
After the confirmation of the rejection of their appeal, the two women entrusted the bitterness to a note released by the lawyer Orazio Celeste: «We are very disappointed and angry. We have embarked on this path strengthened by the previous decisions of the Court of Turin. It is frightening that, at any moment, in such a delicate matter, the Courts may change their mind, regardless of the fact that the future life of a minor depends on this decision. ” Despite the disappointment, the two women announced that the battle continues: “Even outside the courtroom, not for the right to be mothers, but to recognize all children the right to have two parents.” The lawyer explained that the game could continue with an appeal to the European Court of Human Rights. –
