In the case of Lianis Surelys Gutiérrez, According to the petitioners, she is disqualified for working as an auxiliary person. “Taking into account that the position of auxiliary representative holds, among other functions, those of carrying out disciplinary processes and providing support and monitoring to the Disciplinary Committees (sic), and that these functions are considered as functions of the civil authority, and even as functions of administrative authority, it can be concluded that whoever holds the status of auxiliary person would be found covered by the disability provided for in paragraph 2 of article 95 of Law 136 of 1994”.
