If the service mark of a logistics company is printed on a realistic replica of a toy truck, this is only an unfair exploitation of reputation if an attempt is also made to use its appreciation for advertising purposes. In the case of a warehouse model, the Federal Court of Justice has decided that, despite some differences in detail, there is a realistic replica that is not unfair as such.
