The national government issued decree 020 of January 16, 2024 declaring a disaster situation in the department of Chocó, for up to twelve months. This decree is based on Law 1523 of 2012 and refers to the collapse on the Quibdó-Carmen de Atrato road on January 12 where more than forty people died.
The decree applies a special regulatory regime that contemplates exceptional provisions on State contracting, loans, fiscal control of resources, occupation, acquisition, expropriation, demolition of properties and imposition of easements, relocation of settlements, conflict resolution, moratorium or refinancing of debts, suspension of executive judgments, credits for affected people, incentives for rehabilitation, reconstruction and sustainable development, administration and allocation of donations and other measures aimed at guaranteeing the return to normality.
The National Unit for Disaster Risk Management will proceed to prepare the PAE Specific Action Plan for the management of the disaster situation, which must contain the strategies for the response, rehabilitation and reconstruction of the affected areas, and must integrate the actions required to ensure that pre-existing disaster risk is not reactivated.
An official will be designated who will be in charge of compliance with the actions that correspond to his entity in the Specific Action Plan under the guidance and coordination of the National Unit for Disaster Risk Management.
The Ministry of Transportation, INVIAS and the National Infrastructure Agency will coordinate what is pertinent and necessary to intervene on the affected roads and will formulate, structure and execute the lines of the PAE in relation to the transportation sector.
