Two nurses and eight health workers employed by two nursing homes in February had refused the Covid vaccination. For this they were suspended from work and salary because they were not in a position to exercise their profession without endangering the health of the patients. They asked the court of Belluno to reinstate them, but judge Anna Travia said they were wrong. Because they could not be placed for other functions and were “unsuitable for service”, retirement homes had the right to impose forced leave without pay. The sentence closes the specific case, except for appeals and subsequent degrees of judgment, but also highlights the fact that the inanity of politics leads to a substitute for the judiciary.
