The Ministry of Public Health (MSP) expresses its firm rejection of the actions spread by “Diario Nuevo Tiempo”, “Diario Metro”, “El Mercurio”, “Primicias” and in the video shared on the social network TikTok by the Mayor of Cuenca, related to the organization of the Tito ‘El Bambino’ and Makano concert in Cuenca for the Carnival on February 10, 2024.
These actions include the collection of around 50 thousand liters of infant formula milk through the exchange of tickets for the purchase of these products at the ‘Farmasol’ Municipal Solidarity Pharmacies.
This procedure violates the International Code of Marketing of Breastmilk Substitutes and Ecuadorian regulations, which prohibit aggressive and improper advertising of breastmilk substitutes and any form of promotion aimed at the general public.
These publications violate the right to breastfeeding, endangering the health and well-being of children, and violate provisions of our Constitution. Article 32 guarantees the right to health supported by the State, and article 45 protects the right to health of girls, boys and adolescents. In addition, they violate the Organic Health Law, the Law for the Promotion, Support and Protection of Breastfeeding and the Children and Adolescents Code.
Therefore, the MSP requests that the Mayor’s Office of Cuenca desist from this action that violates the rights of breastfeeding. Likewise, it reiterates to all manufacturers, marketers and distributors of substitutes the obligation to strictly comply with current regulations.(I)
