The elegant residential area has been the subject of appeals and counter-claims. The Municipality wants a final pronouncement
MONTEBELLUNA- First she had denied the concession and had found herself with an appeal to the TAR by the owners. Then she had given that concession to build a new building, in addition to expanding the existing one, but she had found herself with another appeal to the TAR of the neighbors who had requested and obtained the cancellation of the building permit.
In the end it will be the Council of State, to which the municipal administration of Montebelluna has appealed, to decide who was right in this mess of authorizations, first denied, then granted, then contested. The case concerns the residential area behind the hospital, residential and elegant, with beautiful villas, where there was still an area free from buildings. There a project was presented to expand the existing building based on the house plan and to build an additional residential building in the adjacent undeveloped area, with monetization of the parking lots.
A denial had come from the Municipality, which was followed by an appeal to the TAR. Then in the town there was a waltz tour between managers and the concession had arrived. But at this point it was the neighbors who opposed the new building, disputing the fact that there had been a concession to build in an area where new buildings were not eligible. And the TAR of Veneto proved them right, canceling the authorization to build given by the Municipality of Montebelluna. At this point, the municipal council wondered how to do it, given the continuous contradictions that existed for a building project that had never begun. And he decided to entrust the final judgment to the Council of State.

At this point, despite being Pilates, we decided that the Council of State would make the decision ».
And so everything was entrusted to the lawyer Maso, who had already sponsored the position of the Municipality before the Veneto TAR, with the task of appealing to the Council of State against the order of the TAR which canceled the authorization to build that was still given in 2018 by the Municipality. But there is also another indirect aspect involved: among the signatories of the appeal that resulted in the winning of the TAR there was also a candidate on one of the center-right lists and therefore within the coalition there are those who suspect that the decision taken by the junta close to the elections, which met in videoconference not fully, it may have been a trip to the allies-competitors.
