The investigation by the Milan Prosecutor’s Office into the real ownership of Milan risks having consequence from a sporting point of view. Giorgio Furlani and his predecessor Ivan Gazidis are contested crime of obstructing the supervisory activity of the FIGCwhich would result in the violation of Federal Sports Justice Codein particular thearticle 32 paragraph 5, to which can be added thearticle 4 and on the front UEFA article 5 of its regulations.

Article 32 paragraph 5 of the Federal Code

All’article 32 “Duties and prohibitions regarding memberships, transfers, assignments and corporate controls” reads: “The company that does not comply with the reporting and filing obligations within the deadlines set by the federal provisions regarding the control of professional companies or admission to professional championships or issue of FIGC licences she is punishedfor any non-compliance, with the sanctions provided for by the same federal provisions or, failing that, with those of a fine or a penalty of one or more points in the ranking“.

Article 4 of the Federal Code

Article 4 it is what forces all those involved in the federal world, therefore also companies and managers, to observe “the principles of loyalty, correctness and probity in every relationship however referable to sporting activity“. Even in this case there is a risk fine and penalty.

Article 5 of the UEFA Regulations

In article 5 of the UEFA regulations we read that”no club, natural or legal person participating in a UEFA club competition may, directly or indirectly, hold or deal in securities or shares in any other club participating in a UEFA club competition; be a member of any other club participating in a UEFA club competition; be involved in any capacity in the management, administration and/or sporting performance of any other club participating in a UEFA club competition; be able to exercise a decisive influence in the club’s decisions by any means”. For the moment there is no UEFA investigation, but if fraudulent conduct to circumvent the provisions of article 5 were to be confirmed, UEFA could exclude Milan and Lille from the European cups.
