No sanctions against Bologna for not playing the match against Inter on January 6, the match must be played and the League of A will set the new date: it is the decision of the sports judge, Gerardo Mastrandrea, who instead postponed – by 31 January – the decision on the non-play of three other matches on the first day of return, Atalanta-Turin, Salernitana-Venezia and Fiorentina-Udinese. According to the sports judge, “the final disqualifying device of the provision of the AUSL of Bologna” (which had quarantined the team after the Covid positive cases of some players, ed), can “validly constitute a case of force majeure, declined under the modalities of the exemption per factum principis, since this is an unnecessary and not predictable determination, in any way – above all – requested by the Bologna company itself, which limited itself to communicating the succession of positive cases among its members for the rest, as far as is known, to comply with the federal protocols validated by the health authority. Therefore, no charge, even in terms of lack of perfect diligence, can be attributed to the Bolognese club, in the face of a provision of the AUSL (at the moment) valid and effective, and this situation seems to have also taken into account the Serie A League. which, also considering the requests for postponement of the Cagliari-Bologna meeting formulated on two occasions by the same Bolognese company, arranged for the aforementioned tender to take place after 9 January 2022, the final date of minimum effectiveness of the provision of the health authority “.
On the other hand, with regard to the Serie A matches, Atalanta-Turin, Salernitana-Venice and Fiorentina-Udinese, which were not played on 6 January, due to the provisions of the competent Local Health Authority regarding some positivity found in some team groups, the Serie A sports judge “has resolved to postpone the rulings on the matches in the epigraph, by 31 January 2022”. The judge believes “it is necessary to investigate every single issue taking into account the peculiarity of the individual cases”.
