breaking latest news – Seventeen years later the Erba massacre returns to the courtroom, one of the popular black novels that most divided public opinion. The Court of Appeal of Brescia recalls all the protagonists of the case, starting with the defendants Olindo Romano and Rosa Bazzi and by the families of the victims, to discuss starting from March 1st the new elements brought in three requests by the lawyers of the spouses, Fabio Schembri, Nico D’Ascola and Luisa Bordeaux, and by the deputy general prosecutor of Milan, Cuno Tarfusser.
Justice has so far expressed no doubts: triple life imprisonment, at every level up to the Court of Cassation, for the defendants found guilty for the murder of Raffaella Castagna, Youssef Marzouk, Paola Galli and Valeria Cherubini and for the attempted murder of Mario Frigerio, which occurred in 11 December 2006 in the Erba court.
But now it opens an extra chapter because the documents presented were deemed worthy of further investigation which means a new trial with requests for evidence, debate, discussion and sentence. Take it or leave it for the two most famous neighbors in Italy: confirmation of the conviction (a reformulation of the entity is also possible) or acquittal.
With possible appeals to the Supreme Court possible for both epilogues. The length of the hearing will depend on how many requests for evidence will be accepted by the judges. All, none or some. Elated Tarfusser: “It’s a huge professional satisfaction that repays me for a whole series of obstacles and harassment in recent times. I’m happy because it means that evidently I didn’t make a mistake. The more I read the documents, the more I believe in them.”
The reference is to the disciplinary proceedings initiated against him on the accusation of having bypassed the hierarchies by proposing the request to Brescia without going through his bosses and the General Prosecutor’s Office of the Supreme Court. Schembri’s satisfaction is more measured: “We are happy, we will discuss to reach a sentence of acquittal“.
The defense relies on consultancy, testimonies, interviews and environmental interceptions interpreted by experts. “The consultancy – he explains – is linked in particular to the reconstruction of the murder of Valeria Cherubini and the disconnection of electricity and the presence of people in Raffaella Castagna’s house in the afternoon before the massacre”.
Also worth reconsidering in this reading are the environmental interceptions on the hospital bed of the survivor Mario Frigerio, a study on electricity in the house of the massacre, the testimony of Abdi Kais, never heard by the investigators, and resident in the house of Erba, who was then arrested for drug dealing in the area where the massacre took place.
The prosecutor spoke of a possible “miscarriage of justice” questioning Cherubini’s bloodstains found on the door sill of Olindo’s car and criticizing the lack of attention to alternative tracks.
The Como Prosecutor’s Office responded in a note to Tarfusser highlighting “the confessions of Rosa and Olindo” and the “certain evidence” including the role of Frigerio who recognized the defendants as the perpetrators of the crime.
In the direct summons for trial, the lawyer Manuel Gabrielli, who died on 7 January 2023 at the age of 47, is also indicated. He was not the only one to leave in these long years in which media attention has never diminished. Frigerio passed away on 16 September 2014 (the children Elena and Andrea are civil parties), on 30 March last year the Carabiniere Luca Nesti, among the first to deal with the matter. At the moment Rosa, imprisoned in Bollate, and Olindo, in Opera, have not been informed of the news.
