Corruption Eradication Commission (KPK) stated that he could apply the Money Laundering Crime Article (TPPU) to the family of former Minister of Agriculture Syahrul Yasin Limpo (SYL) when the element of intentionality is met.

“If TPPU contains money from crime and then it turns into economic value, whether for example buying a house, the house is then handed over to the nuclear family or whoever does it intentionally and he knows that this house was obtained from a crime case, can he be punished? Yes,” said Head of the KPK News Department, Ali Fikri, at the KPK’s Red and White Building, Jakarta, Thursday (2/5).

Ali explained that the income of every state administrator can be measured. If there are assets or assets that do not match the profile, he continued, this should be suspect.

“For example, in the Hasbi Hasan case, it was clear how much he earned, then he handed over a house worth billions to someone who had been named a suspect (Windy Idol), and he (Windy Idol) knew,” said Ali.

“So, she (Windy Idol) fell into enjoying the proceeds of corruption crimes which turned into assets. That means TPPU and she can be subject to TPPU, the passive article. Not a TPPU perpetrator, but she also enjoyed the proceeds of crime,” he continued.

Ali emphasized that the SYL family could also be subject to TPPU articles like Windy Idol. However, this must first be proven, the main case is the alleged extortion and receipt of gratuities, and there is an element of intent.

“Yes, it is very, very possible when there is an element of intent, you can also enjoy the proceeds of crime. This will first be proven as a crime of corruption,” stressed Ali.

During the trial process at the Central Jakarta Corruption Court, it was revealed that SYL used the Ministry of Agriculture’s budget for personal and family interests.

These include payments for children’s beauticians, renovations to children’s houses, monthly deposits to wives, purchasing cars for children, and paying SYL credit card bills.

SYL, who is a NasDem Party politician, was charged with extortion of up to IDR 44,546,079,044 and receiving gratuities considered bribes amounting to IDR 40,647,444,494 during the 2020-2023 period.

This crime was committed by SYL together with two other defendants, namely the Secretary General of the Ministry of Agriculture, Kasdi Subagyono, and the Director of Agricultural Equipment and Machinery, Directorate General of Infrastructure and Facilities, Ministry of Agriculture, Muhammad Hatta.
