Recently, several victims of this major financial case reported to the “China Times” that after they handled the large-denomination certificate of deposit business at ICBC, the deposit was quietly transferred by Liang Jianhong, a senior executive of ICBC Nanning Branch, but the court of first instance found Liang Jianhong. The bank is not responsible for any compensation for the theft of the depositor.

These depositors ask: How can money be stolen in the bank during the day? Why can banks be completely exempted from liability?

On May 21, 2019, a woman named Shi surrendered to the police and admitted that she was the personal assistant of Liang Jianhong, an executive of ICBC Nanning Branch. The depositors’ money was quietly transferred. The next day, Liang Jianhong was arrested by the police and fired by ICBC.

Before the incident, Liang Jianhong was the general manager of the personal financial business department of ICBC Nanning Branch. She was mainly responsible for the personal business of ICBC Nanning Branch in Nanning, including savings deposits, wealth management and personal loans.

On November 19, 2021, the Nanning Intermediate Court made a first-instance verdict: Liang Jianhong was sentenced to life imprisonment for the crime of theft, fraud, forgery of financial documents, etc.; Shi and the other two criminals were sentenced to seven to fifteen years. fixed-term imprisonment; order the defendants to refund the economic losses of the victims.

It is reported that when Liang Jianhong was detained by the police in May 2019, he was charged with the crime of embezzlement. However, in the prosecution stage, the charges were changed to theft, fraud, and forgery of financial documents.

The 253 million certificates of deposit are included in the theft. Liang Jianhong’s crime of fraud involved a victim of more than 2 million yuan that was not returned; forged financial documents involved forging 350 bank documents such as certificates of deposit; in terms of fundraising fraud and illegally absorbing public deposits, it involved absorbing funds from 48 fundraising participants. About 3.56 billion yuan, and the actual loss of fundraising participants is about 150 million yuan.

In terms of theft of certificates of deposit, according to statistics, Liang Jianhong stole a total of about 253 million yuan from 28 victims, including Li Si and Zhang Shan. Excluding some of the funds that had been returned before the incident, about 120 million yuan remained unreturned after the incident. .

According to the victim’s report and the verdict confirmed, on December 7, 2018, in the Industrial and Commercial Bank of China Nanning Donggedong Sub-branch, a depositor used to do business with a fake deposit certificate replaced by Liang Jianhong. . However, the case was finally settled, and Liang Jianhong was able to continue committing the crime for half a year.

The above-mentioned reports have aroused public attention and heated discussions. Xu Gang, a lawyer specializing in criminal defense in mainland China, said on Weibo, “There is something wrong with this kind of judgment. The customer deposits in the bank and establishes a savings contract. When the customer delivers the funds to the bank, they have a claim on the bank. The obligation of the bank is to Pay the principal and interest to the customer according to the deposit contract. The money is missing from the bank, and the criminals violate the bank, not the customer. Therefore, the bank also needs to fulfill its own obligation to pay the customer’s principal and interest!”

In May 2018, Wang Yuqing, a former employee of the Industrial and Commercial Bank of China branch in Daxing’anling, Heilongjiang, complained to The Epoch Times that he was retaliated against for reporting a colleague who stole deposits from depositors, and was forced to resign because the person who was reported was the son of the president of ICBC.

Wang Yuqing said that she had worked in the Industrial and Commercial Bank of China branch in Tahe County, the Greater Khingan Mountains region. In 1991, she discovered that there was a robbery within ICBC, and saw that a colleague, the first-generation clerk, Zhao Zhimin, stole a bundle of small receipts, totaling 10,000 RMB, from the cash box when he got off work. Two days later, she submitted a written whistleblower report to the superior county bank, but there was no follow-up.

In 1998, she sat at the window with Zhao Zhimin, and saw him steal a bundle of small receipts worth 10,000 yuan. She wrote a report letter to the county bank again, but still nothing.

Wang Yuqing said: “Some depositors were illiterate (the old farmer’s wife), so he asked the depositors to fill in the receipts, and when they found out that they were illiterate, they stole their money. One was 8,000 and the other was 2,000. Later, her (the depositor) husband gave them to her husband. Angry. I see nobody (depositors) is credited. He often steals depositors’ cash.”
