National collective labor agreements continue to proliferate: 933 were deposited in the CNEL archive (as of November 22), in just one year there was an increase of 77 CCNL (equal to + 9%), in ten years the 170%, with a decidedly “anomalous” trend. Of these, 353 contracts (37.8%) are signed by employers’ and trade unions associations not represented at Cnel, they cover very few workers (33 thousand), often have worse contractual conditions, with amounts below the minimum of the reference contracts that produce damage economic to employees, penalizing healthy companies in terms of contractual dumping.

Although the number of national contracts has been growing for several years now, most of the workers are concentrated on a few national collective labor agreements: the first 54 cover 75% of workers, the remaining 879 less applied only 25% of workers. In all sectors, the top 5 most widely applied national collective labor agreements cover at least 80% of workers, and in 6 out of 12 sectors they cover more than 90%.

Unique alphanumeric code

To counter the spread of “pirate” contracts signed by poorly representative social partners – in some small companies there are cases in which employers’ representatives and trade unions are based on the same landing – there is a tool in place: the unique alphanumeric code of the national collective labor agreements, established by law 120/2020 (the Simplification decree on the proposal of the CNEL), which assigns the attribution to the CNEL (which manages and manages the national archive of public and private employment contracts).

It is a sort of common registry of collective agreements organized with a view to public service and transparency, it was underlined in the presentation to the CNEL by president Tiziano Treu, with the INPS president Pasquale Tridico, the head of the cabinet of the Ministry of Labor Elisabetta Cesqui and the director of the National Labor Inspectorate Bruno Giordano.

Bimonthly transition period

Basically, in the mandatory communications to the Ministry of Labor and in the monthly wage reports sent to INPS, the data relating to the national collective agreement applied to the worker must be indicated by means of the unique alphanumeric code attributed by Cnel. The passage on the Uniemens flow to the single alphanumeric code of the CNEL is envisaged, after a transition period, lasting two months (in December 2021 and January 2022), in which it will also be allowed to use the INPS code, to allow employers , consultants / intermediaries and their applications to adapt to the new code. From the competence of February 2022, the transmission of the data relating to the National Collective Labor Agreement will take place exclusively through the unique alphanumeric code attributed by the National Collective Labor Agreement.
