The rumors leaked in the morning on the resignation of Gaetano Micciché, number one of the Imi-Cib division of Intesa Sanpaolo, from the RCS board of directors for personal reasons are confirmed.

The point on the RCS-Blackstone affair

With regard to the judicial controversy, it emerged, according to what Radiocor reconstructed, that the two cases, initiated by Blackstone against RCS and Urbano Cairo, will be entrusted to the same judge, Andrea Masley (so far the only holder of the second proceeding that sees the American fund act against Cairo himself). This was decided by the New York Supreme Court after Judge Andrew Borrok stepped back, who had been assigned the main Blackstone-Rcs file.

Last week, in fact, Borrok had refused, as he explained in a letter to the Court, “to avoid suspicions of irregularities based on some recent social and other interactions with some members of Blackstone”. Hence the decision of the Court to assign the file initially to Judge Jennifer Schecter, and then also pass this procedure into the hands of Masley, who will now manage both.

The maxi claim for compensation

Blackstone’s lawyers have long asked the Supreme Court to reunite the two originally separate damages cases for compensation of up to $ 600 million. While waiting for the counter arguments from RCS to arrive by the end of August, we will have to wait to understand what Masley’s first decisions will be. If he decides to “unfreeze” the two proceedings, which have been in the pits for years awaiting the Italian award, he will also have to express himself on the delicate issue of territorial jurisdiction (which for RCS is from Milan, for Blackstone from the USA).
