The vaccination must exist initially, for the purposes of new registrations in the register, and must persist over time. Therefore, the suspension ex lege from exercising professional activity due to lack of vaccination can only be considered as suspension tout court, and not limited to activities in contact with people. Furthermore, any recourse to Cceps will not have an impeding effect. Thus the Ministry of Health in a circular of clarification to the Orders. Rings (Fnomceo): “It brings certainty about the actions of competence of the Orders”. THE CIRCULAR
23 SET – The anti-Covid vaccination of healthcare professionals is an essential requirement to carry out the professional activity. It must initially exist, for the purposes of new registrations in the register, and must persist over time, in each phase, under penalty of suspension from the exercise of the profession. Therefore, the suspension ex lege from exercising professional activity due to lack of vaccination can only be considered as suspension tout court, and not limited to activities in contact with people. Furthermore, any recourse to the Central Commission for Healthcare Professionals (Cceps) will not, in any case, have the effect of preventing the application of this suspension, which is not a disciplinary sanction.
This is clarified once again by the Ministry of Health, which sent – three months after the previous communication – an explanatory circular to all the Federations of the Orders of the health professions. Note that today the Federation of the Orders of Surgeons and Dentists (Fnomceo) has spread to the 106 territorial Orders.
“We appreciated, once more, the commitment of the Minister of Health, Roberto Speranza, and the attention to the issues raised by the Federations of the Orders of the Health Professions – comments the President of Fnomceo, Filippo Anelli -. This circular is, in fact, the result of a listening process promoted by the Minister, who worked to overcome the problems that emerged and give uniformity to the application of the law throughout the country ”.
“The clarification of the Ministry of Health, which adheres to the policy already provided by Fnomceo to the Orders, brings certainty about the actions within the competence of the Orders themselves – concludes Anelli -. And it firmly establishes that vaccination is a fundamental requirement to be able to practice the health professions, as well as a degree and a qualification “.
