CERVIGNANO. According to the public accusation, the stab wounds inflicted by Gennaro Martire, 33, originally from Castellamare di Stabia (Naples) and residing in Cervignano, to Igor Luca, Moldovan, also 33 years old and residing in Cervignano, on the night of April 15, 2019, at the outside the “Pino” bar in Cervignano, they did not cause his death “by mere chance”.

But they could have killed him. And then, if we are talking about an attempted murder, he will have to be sentenced to 9 years and 6 months of imprisonment. For the defense, however, the injuries sustained by the victim, at the base of the neck and under the shoulder, fall within the less serious case of personal injuries and were in any case the consequence of a struggle from which the martyr himself came out battered. On closer inspection, therefore, it was not an aggression, but a legitimate defense.

It is on these conclusions that the curtain has fallen on the trial that sees Luca himself and his compatriot and contemporary Victor Cricimari, also from Cervignano and in turn involved in the dispute, called to answer only for the crime of brawl. Accusation also disputed to Martire.

The sentence that will decree whether and what degree of responsibility to attribute to the accused, in the face of the opposing theses supported by the prosecutor Letizia Puppa and by the lawyers Federica Zambon, for the Campania region, and by his colleague Franco Crevatin, who defends the other two and who acquittal “because the fact does not constitute a crime”, insisting in turn on self-defense, will be known on 8 July. With the discussion closed, the Udine collegiate court chaired by judge Paolo Alessio Vernì (alongside colleagues Paolo Lauteri and Mauro Qualizza) in fact decided to postpone the parties to another hearing for any replies and then retire to the council chamber.

The minds, that night, had not overheated at any moment. Before meeting in front of the “Pino” bar, in via Aquileia, Martire and a Sicilian friend of his, whose position was removed, had met and started a conversation with the two Moldovans in another bar. According to what was reconstructed by the lawyer Crevatin, the Italians had turned to them with a couple of proposals to make easy money: women to start prostitution or export of stolen cars. Finding no evidence of interest, the matter seemed closed there. Then, however, their paths had crossed again and this time the words had quickly passed into hands.

It is at this point that the versions diverge. According to the investigators, Martire had taken a knife from the car and with it had attacked Luca from behind. The wounds were judged to be healed in 15 days. Shortly before, Cricimari had caught them too: hooded with his own jacket, he fell to the ground and was kicked there. Taking refuge in the bathroom to check his wounds, he would not have witnessed the stabbing and, once he found his bloodied friend, he would have chased the bell as he ran away, until he got him and ended up on the ground. It was the carabinieri, alerted around 4, who intervened and closed the circle in a few hours, with the identification and arrest of Martire
