Council of State denied demand for “political death” against Hernández

The Council of State denied a lawsuit for “political death” or loss of investiture, against former presidential candidate Rodolfo Hernández, filed on October 7, 2022.

Said petition was filed by Nisson Alfredo Vahos Pérez and Yezid Gaitán Marín, apparently because Hernández would have demanded that his then campaign participant Marelén Castillo impose on members of his then legislative work unit. For this reason, one of the arguments was influence peddling.

It should be remembered that Hernández acknowledged that he had sent an email to Castillo, requesting him to review certain resumes, but he did not make any type of demand for his hiring.



“If it was not shown that former senator Rodolfo Hernández Suárez improperly influenced the representative of the Chamber, Marelen Castillo Torres, to have someone postulate in her UTL, it is not possible to configure the fourth requirement of the cause under study. If Well, at the time of the facts, the representative to the House was selecting those who were going to apply to integrate her UTL, because she was close to assuming the seat, according to the evidence, it was not evidenced that this application was conditioned by an undue influence of Rodolfo Hernández Suárez”, says the ruling in favor of the former mayor of Bucaramanga.

Finally, Judge Guillermo Sánchez argues that there is no solid evidence to prove influence peddling by Rodolfo Hernández, for this reason, he is acquitted of loss of investiture.
