The Bari preliminary hearing judge Antonella Cafagna has indicted the doctors Massimo Buonfantino (head of surgery at the San Paolo hospital in Bari) and Bianca Pascazio, accused of cooperation in manslaughter and negligent liability for death in a healthcare setting in relation to the death of the 51-year-old Enza Brescia. The woman, from Bisceglie, died on December 21, 2022 in hospital after undergoing some surgeries. The prosecutor Alessandro Donato Pesce, who coordinated the investigations, requested the dismissal of the case for the surgeon who carried out the first operation but the family (assisted by the lawyers Dario Galantino, Adriano Cozzoli and Emily Cocozza) opposed it. The discussion hearing will be held on April 10th.


The indictment of the two doctors, said the lawyer Cozzoli, “marks a step forward towards ascertaining the truth so that Enza Brescia and her family members receive justice”.


The woman entered the operating room on September 26, 2022 for a laparoscopic operation on the left side, then converted to a right pararectal laparotomy, and manifested a post-operative syndrome characterized by general malaise with dyspnea, by the appearance of a hematoma/swelling in the parathoracic artery’, by a PCR value that was ‘too high’ and by ‘a CT scan of suspected intestinal perforation’, as stated in the prosecution documents. According to the prosecutor, the head doctor and medical director failed to carry out ‘appropriate monitoring’ of the 51-year-old, discharging her ‘early’ four days after the operation. From October onwards, due to further complications, the woman underwent ‘numerous other surgical operations’, and she died in hospital from ‘irreversible cardio-vascular dysfunction secondary to a severe and persistent septic state’.
