Pop.Bari: bank sentenced to repay securities to three customers

Brindisi Court ruling, ‘information obligations violated’

(ANSA) – BARI, 17 SEPTEMBER – The Court of Brindisi sentenced the Banca Popolare di Bari to pay the entire sum corresponding to shares purchased starting from 2010 to three savers. The three savers, assisted by Antonio Pinto lawyers and Antonio Amendola of Confconsumatori, had filed an appeal against Banca Popolare di Bari highlighting – as recognized by the judge – “the failure that the bank had with respect to its obligations to inform customers”.

“The bank – explain the lawyers – was sentenced to pay 100% of the sums invested, with the exception of those paid over ten years before the interruption of the prescription”.

In the sentence, the judge quantifies the total investment in shares at over 180 thousand euros, “with total loss of the capital invested”. “In the absence of any specific information to customers, not only about the nature and characteristics of the security – explains the Court -, but above all the financial situation of the issuer, its rating and any default situations (perhaps the reasons why a the bank decided to turn so massively to the audience of non-institutional investors with risk capital issues), it must be considered that the intermediary has failed to comply with the most basic disclosure obligations “.
