Meanwhile, lawyer Morrone, who defends two defendants, announced on the sidelines of the process injunctions for the offended parties who have not honored all the fees. Only ten of them filed a civil action at the trial

IVREA. There is a date for the trial of the tax lawyers Boaglio di Caluso: it is July 15th. Only the children Massimiliano, 39, and Giuliana, 52, will appear before the judging panel of the Ivrea court, together with the collaborator of their firm, the 33-year-old Simona Ventre. His father Renato, in fact, died at 88 last October, so his file was extinguished due to the death of the accused. The three are accused in various ways of fraud and embezzlement.

The prosecutor Lea Lamonaca, who conducted the investigation from the beginning coordinating the men of the Ivrea Finance Police, is working in the meantime to close an investigation line bis. However, these are not different crimes, but only complaints and complaints – about twenty – arrived after the investigations and advice received. In order not to extend the time, then, the magistrate decided to close the first part with 57 offended people and 95 total charges.

Of these, however, only ten, between companies and individuals, have joined the process as a civil party. “It is proof – underline the lawyers Cristina Morrone of Milan, who defends Massimo Boaglio and Simona Ventre, and Paolo Micheletta of Turin, who defends Giuliana Boaglio – that many complaints have come about the emotional wave of the moment and that there were no sufficient elements to constitute a civil party “.

Morrone adds: “The Court of Appeal of Turin, in civil proceedings, has just recognized that one of the offended people was in debt to the Boaglio, after an injunction had been sent to it”. It should be remembered, however, that the offended persons have the right to request compensation even in civil proceedings. Furthermore, the civil constitution of all the offended persons who requested it was accepted, despite the fact that the lawyers had pleaded the nullity of some requests.

The accusation made by the prosecutor against the tax authorities is that they stole the money paid to pay taxes from customers. They are mostly traders, artisans, small entrepreneurs who placed great trust in the Boaglio and who from one day to the next found themselves full of debt. But also of companies that have no longer had access to their accounting records, such as the one that filed a civil action through the lawyer Guido Cellerino.

The victims entrusted their money to the tax authorities, which was supposed to be used to pay taxes, but which, according to the investigation, ended up elsewhere. The investigations were long and complex. Some clients of the firm had noticed that something was wrong and, after receiving the files from Equitalia for the payment of unpaid taxes, had turned worriedly to the suspects, but from the firm they would have reassured them, telling them that it was ” crazy folders ”and that they shouldn’t have paid that money because everything was in order. The non-payments by the firm would span a period of almost 15 years, with figures ascertained by the prosecutor but which in part could not be documented, especially in the case of cash payments.
