The German consumer rights association VZBV has filed a collective legal action against Daimler, filing a complaint with the Stuttgart court of appeal, as part of the so-called dieselgate. The organization’s goal is to obtain damages for buyers of Mercedes models due to the manipulation of data on exhaust gases detected some vehicles then withdrawn.
“Those who have been damaged will know for sure if Daimler had deliberately installed devices (for manipulating the results, ed) in different models,” said the president of the association, Klaus Mueller. “Despite the recalls, Daimler denies having deliberately manipulated the emissions of its cars. The Stuttgart Court of Appeal should rule on this. It would bring legal clarity to many consumers who have been hit ”.

Daimler replied that the lawsuit is “baseless” and will contest the association’s case. The VZBV estimates that approximately 254,000 cars have been recalled to Germany to date. The recalls were issued in 2018, and the association began organizing its action before Daimler’s prosecution expired after a three-year window. The company reiterates that it acted correctly in an episode of the scandal that cost, only to rival Volkswagen, over 32 billion euros in reimbursements, fines and legal costs.
