When is the Eid holiday in 2024?

According to the Cabinet Secretariat website, a Joint Decree (SKB) from the three ministries was issued at the end of 2023. The SKB is the result of a government decision from the Minister of Religion (Menag), the Minister of Manpower (Menaker), and the Minister for Administrative Reform and Bureaucratic Reform (PANRB).

From the decree, Eid al-Fitr 1445 H is set to fall on April 10 and 11 2024.

Furthermore, in SKB Number 855 of 2023, Number 3 of 2023. Number 4 of 2023, it is also reported regarding the decision to determine national holidays and collective leave in 2024.

From the contents of this SKB, it is known when to go on holiday together before and after Eid al-Fitr 1445 H.

List of holidays and holidays for Eid in 2024

Quoting from the contents of the Joint Decree on the official website of the Cabinet Secretariat, the following is a brief list of holidays and holidays for Eid al-Fitr 1445 H:

  • Saturday, April 6 2024: Weekend holiday
  • Sunday, April 7 2024: Weekend holiday
  • Monday, April 8 2024: Holiday with Eid 2024
  • Tuesday, April 9 2024: Holiday with Eid 2024
  • Wednesday, April 10 2024: Eid al-Fitr 1445 H

    Rules for employees who come to work during the 2024 Eid holiday

    Even though there is an official determination regarding holidays and dates for collective leave each year, there are several jobs that are excluded from the Eid holiday agenda like this.

    When going home, you and your family often find that even on Hari Raya and holidays, there are still police or employees at a company who continue to work as usual. Sometimes your little one also wonders why these workers can’t go on holiday.

    Referring to Law Article 85 Number 13 of 2003 concerning Employment, several points are explained regarding employees and companies who continue to work on holidays, namely:

  • Workers or laborers are not obliged to work on official holidays.
  • Employers can employ workers/laborers on official holidays if the type of work is as follows: 1) carried out continuously, 2) there is an agreement between the worker and the entrepreneur.
  • Employers are obliged to pay overtime wages to workers/laborers who continue to work
  • From the second point, it is said that there are several jobs that do not have the opportunity to participate in the Eid al-Fitr holiday, Mother. What are those jobs?

    Based on article 3 paragraph 1 of the Minister of Manpower and Transmigration Decree number KEP-233/Men/2004, there are 11 types of work whose implementation is continuous, namely:

  • Health services
  • Transportation services
  • Transportation equipment repair services
  • Tourism business
  • Provision of electric power, clean water service network (PAM), provision of fuel and gas
  • Postal and telecommunications services
  • Mass media
  • Security services
  • Work at a conservation agency
  • Jobs in supermarkets, shopping centers and the like
  • Work that if stopped will disrupt the production process, damage materials, and include maintenance/repair of production equipment

    The eleven types of work above cannot freely follow the leave and Eid holidays agenda set by the SKB. That is the reason they still come to work on these days because of the importance of their presence at all times.

    Find out the difference between joint leave for Eid al-Fitr 2024 for private employees and civil servants

    Determining the date for collective leave during the Eid al-Fitr 2024 holiday will be 4 days. It’s quite a long time, as if it provides an opportunity to take a temporary break from work, yes.

    Generally, national collective leave is not included in the annual leave allowance that each worker has while working. This is because this leave is a government agreement, it should not reduce the annual leave allowance available at the office.

    However, is that really what it says? It turns out that there is a big difference in annual leave rules between private employees and civil servants.

    Annual leave rules for private employees

    For private employees, the shared leave allowance specified above will reduce the amount of annual leave they have. This rule is as stated in the Joint Decree previously mentioned.

    In the fourth dictum it is stated that, “The implementation of Collective Leave as intended in the FIRST Dictum reduces the annual leave rights of employees/employees/workers in accordance with the provisions of the laws and regulations and provisions that apply to each work unit/organizational unit/institution/company.”

    Then it is further strengthened in the sixth dictum with a regulation that explains, “The implementation of Collective Leave as intended in the FIRST Dictum for private institutions/institutions is regulated by their respective leaders.”

    From these provisions, it can be clearly seen how the rules for collective leave for private employees have certain provisions. Shared leave will reduce annual leave and sometimes private employees have to be prepared to continue coming to work during the leave.

    This is due to the facultative nature of collective leave in the private sector, as written in the sixth dictum of the SKB above.

    As the Minister of Manpower, Ida Fauziyah, said on the Ministry of Manpower’s website, “Because it is facultative, (private sector leave) is not mandatory and there are no fines.”

    Annual leave rules for civil servants

    Well, it’s different with PNS or what is now called ASN (State Civil Apparatus). If private employees experience a reduction in the amount of annual leave, then civil servants are not subject to it at all. Leave with the Eid holiday in 2024 is an additional leave bonus for ASN employees.

    Still in the same SKB, the fifth dictum is stated, “The implementation of Collective Leave for State Civil Servants is carried out in accordance with the provisions of statutory regulations.”

    The law referred to in the dictum is Presidential Decree (Keppres) Number 7 of 2024 concerning Joint Leave for State Civil Service Employees in 2024.

    In the first dictum of the Presidential Decree, the date for joint leave for the Eid holiday 2024 is announced, which is then followed by further explanation in the second dictum, “Joint leave as intended in the FIRST dictum does not reduce the annual leave rights of State Civil Service Employees.”

    Then, if ASN is ordered to go to work on the day of collective leave, then he is entitled to additional days of annual leave. This is stated in the third dictum, “State Civil Service employees who, because of their position, are not given the right to collective leave, have their annual leave rights increased according to the amount of collective leave that is not granted.”
