PORDENONE. The appeal process on the collapse of Fadalti spa in Sacile wiped out eight sentences, more than halved the penalties, drastically reduced the compensation to the bankruptcy and zeroed that to Mediocredito.

The Court of Appeal of Trieste, second criminal section, has redetermined the sentence (suspended) in 2 years each to the president of the board of directors Piero Fadalti, to the deputy Luisa Fadalti and to the alvise Faotto (no mention for the last two).

Only one charge survived: the attribution of fringe benefits without a shareholders’ resolution when, according to the prosecutor, the spa was already in crisis (personal use of luxury cars, for the Fadalti also taking materials from the bankruptcy).

Luisa and Piero Fadalti and Faotto were sentenced to compensate the extraordinary administration Fadalti spa, civil party with the lawyer Luca Ponti, € 359,114.20, in addition to legal interest. A figure far from that set in the first instance: 5 million euros in provisional.

All other civil rulings revoked, including the 500 thousand euro provisional payable to Mediocredito Fvg, set up with the lawyer Serena Giliberti. There is no need to proceed against the administrator Emanuela Fadalti: the crimes have been extinguished as she died.

Luisa and Piero Fadalti, Faotto and the administrator Gabriele Verardo di Brugnera were acquitted because the fact does not exist instead of the hypothesis of willful bankruptcy for which they had been convicted in the first degree.

The lawyer Giuseppe Campeis, for Verardo, had challenged the new qualification for the incorrect application of substantive and procedural rules, accepted on the merits.

Exempted on appeal, after conviction in the first degree, of the simple bankruptcy charges: the former directors Giancarlo Puppo of Genoa and Claudio Borea of ​​Sanremo, the board of directors in charge of the last months of Fadalti’s life, (Giorgio Ghezzi from Bergamo, Pietro Codognato Perissinotto di Silea, Claudio Tatozzi from Milan and Dimitri Guarino from Pordenone).

The Court rejected the appeals of the general prosecutors and of Pordenone, confirming the acquittals of the defendants of Friulia and of the boards of auditors.
