Mise clause on aid: priority to hiring workers in crisis

Establish a path on hiring for companies that receive incentives and reorganize the management of crisis tables. Two distinct documents from the Ministry of Development (Mise) thus intervene on the matter at the center in these days of the debate on the Orlando-Todde decree on closures and relocations. It is a different approach that emerges from the two interventions that the Minister for Economic Development Giancarlo Giorgetti had been working on for several weeks. It is no mystery, moreover, that the current draft of the Orlando-Todde decree does not enjoy the favor of the exponent of the League, not following his idea on the paths to be followed in this field, also supported publicly.

Mandatory clause for beneficiary companies

An address, signed by the head of cabinet on the recommendation of Giorgetti and sent to the general directorates, to the deputy minister Alessandra Todde (who has the delegation on the crisis tables) and to the deputy minister Gilberto Pichetto (delegation to industrial policy) provides that an employment clause is inserted in the measures for the granting of incentives, concessions, development contracts or in general financial support measures by the Mise. The beneficiary companies, in the event that an increase in employment is envisaged, must undertake, within the context of the respective needs of employees, and clearly after verifying the existence of the professional requirements, to primarily hire workers resident in the area where the investment is located and who receive income support interventions (therefore shock absorbers and other wage supplements), or who are unemployed as a result of collective dismissal procedures and, subsequently, workers of the companies in the reference area involved in the crisis tables of the Mise.

Perimeter of national crises

Precisely those crisis tables whose management has been the critical point of the ministry for years. To clarify the procedures and also the data of the tables actually opened and closed, Giorgetti signed a directive establishing a framework within which, obviously, the Deputy Minister Todde, who has the delegation on the matter, will also have to move. Article 1 defines the criteria for identifying crises of national importance that can be dealt with by the Ministry’s Crisis Structure (led by Luca Annibaletti since last June): companies with at least 250 employees hired in Italy (including temporary workers, apprentices and part-time workers); companies located in more than one region in Italy, whose state of crisis can have significant impacts on employment or on the production system; companies of significant national interest pursuant to the legislation on “golden power” and the impact on related activities; companies owning historical brands.

Review of the procedure for starting the crisis tables

Without prejudice to the possibility of proceeding ex officio, four types of subjects can request the opening of a table: the company itself, its creditors, national administrations and the Regions; the trade unions. The structure of the Mise, in the event that the conditions are met, analyzes the causes of the crisis, verifies possible industrial rescue plans and plans for training and relocation of workers, transmits information to the Committee for the attraction of foreign investments to propose reindustrialisation to foreign investors. It will have to be clarified what it means to close a table (due to the overcoming of the crisis or the ascertained impossibility of a solution).

In fact, numbers have been circulated with too much ease up to now on the closure of disputes, without transparently providing details on both the names of the companies and the individual outcomes (reindustrialisation? Relocation of workers? Bankruptcy?). The census released by the offices of Deputy Minister Todde speaks of 87 tables compared to 150 in December 2019. Article 5 of the directive, on the provisions on transparency, establishes that every six months, on the ministry’s website, a report on crisis management activities, which gives an account of the open tables, the outcome of the meetings held and the analysis, study and monitoring activities that are carried out.
