Persecuting the other party’s lawyer with threatening phone calls, messages and emails, even presenting a complaint to the victim’s Bar Council, integrates the crime of stalking.
This is the decision of the Gup of Rome, which sentenced a 44-year-old man to 8 months’ imprisonment (with suspended sentence) by applying the security measure of probation for a year. Not only; while deeming the defendant’s ability to understand greatly diminished, not only were the extenuating circumstances not recognized, but the man was sentenced to pay damages in favor of all the civil parties, i.e. the lawyer, his client and the Council of the Bar Association of Rome.
The Capitoline Forensic Order itself made known and explained the story. The story concerned a dispute between a man and his lawyer, who defended him in financial matters. “The disagreements – reads a note – then transcended into persecutory attitudes not only towards the professional, but also towards her sister, in turn a lawyer, who had assisted her in filing a complaint. The latter was lost driven for a long time with silent phone calls, threatening messages and even with a delusional anonymous complaint sent to the Council of the Order of the Capital”.
Just the COA of Rome, represented by the lawyer Giovanna Gallo, appeared in court as a civil party. “We wanted to support my colleague not only because as a Roman Bar Association we pay particular attention to gender issues – explains President Paolo Nesta – but also to protect and defend the dignity of the lawyer, who must always be free to practice the profession without conditioning For this reason we are very satisfied with the ruling of the Gup, which recognized in a clear and crystalline manner the principle of the independence of the lawyer. We hope that the decision represents a warning to many who engage in inappropriate behavior towards their lawyers”.
