“No one is the exclusive master of the process and its rules, the process belongs to everyone and the barricades are useless, we are all part of a mechanism which if it doesn’t work causes enormous damage: the process must be fair”. Thus the representatives of the Criminal Chamber of Milan presented the moment of discussion that is underway, in the maxi appeal courtroom, between lawyers and magistrates on the occasion of the abstention of the Milanese criminal lawyers today in conjunction with the hearing of the trial to Alessia Pifferi.


A strike, called by the Criminal Chamber and joined by the Milanese Bar Association, to protest against the methods of the parallel investigation opened by the prosecutor Francesco De Tommasi against the lawyer Alessia Pontenani, who defends the woman accused of having let her die his daughter Diana, and the two psychologists from San Vittore, all accused of forgery and aiding and abetting.


About ten Milanese prosecutors were also present at the meeting, as well as Leonardo Lesti, president of ANM Milano, the president of the Court Fabio Roia, the president of the Court of Appeal Giuseppe Ondei and the president of the Surveillance Giovanna Di Rosa. The prosecutor Marcello Viola, who was invited, chose not to participate but, as explained by the president of the Criminal Chamber Valentina Alberta, “he expressed to us in writing his desire to resolve concrete problems and we take his willingness to work for common purposes seriously”.


The Milanese lawyers, essentially, believe that the new investigation opened during the ongoing trial, complete with searches, violated the right of defense and the principle of fair trial and was an “interference” by the prosecutor in the hearing. “The Criminal Chamber reacted – explained the lawyer Francesco Sbisà – not because a defender was under investigation, even if only the psychologists had been investigated, precisely because of the object of the accusation, the timing and the method we would still have intervened”.
