An exact amount of damage cannot yet be quantified. However, it is now clear that it is well over five million euros: the Wels public prosecutor’s office has transferred the investigations against a lawyer, a notary and an expert to the economic and corruption public prosecutor’s office (WkStA). A mandatory step if the damage exceeds the limit of five million euros.

As reported, the defendants are accused of having enticed a woman suffering from dementia to sign a handover agreement, two gift agreements in the event of death and a power of attorney in 2022, taking advantage of her poor health and inexperience. She thereby transferred her entire agricultural property (39 hectares) in Pasching (Linz-Land district) including real estate assets to her late husband’s nephew. The public prosecutor emphasizes that the woman had previously spoken out against this in a legal dispute for seven years.

The same lawyer, the same notary and the same appraiser who were involved in a real estate deal on the eastern shore of Lake Traunsee in 2019 are being investigated. Charges have already been brought against the lawyer and the notary in this case, and the expert, a psychiatrist from Linz, is accused of several “courtesy reports” – he is in custody.
