Chaos Procure: for the Perugia Gup “wiretapping on Palamara can be used”

by admin

Luca Palamara’s talks intercepted with the trojan, a computer virus with which his mobile phone had been infected, can be used in the proceedings underway against him in Perugia. And there is no need for an expert opinion on the server on which the audio files have passed. This was decided by the gup of the Umbrian capital who rejected the defense request of the former CSM adviser to declare the interceptions unusable and to arrange the technical assessment. Application linked to what emerged following a complaint presented to the prosecutors of Florence by the lawyers of Palamara and by Cosimo Ferri. In other words, the flow relating to the data captured by the Trojan had passed through a ‘technical’ server installed in Naples by the company in charge of the operations before arriving at the ‘official’ one in Rome. An impulse was also ascertained from the cell phone of the former CSM adviser at the beginning of September 2019, when the operations were formally ‘closed’. The deeds were then filed by the prosecutors of Perugia in the preliminary hearing in which Palamara is accused of corruption and in which the judge had the specialized staff of the postal police perform a technical assessment in contradiction between the parties (it is among the it also emerged that the 20 audio files found on the Naples server were “created” before the authorized term for interceptions). Today the GUP rejected the request for unusability, underlining for the interceptions through the computer detector “the systems were installed in the server rooms of the prosecutors in full compliance” with the rules governing these operations. “In conditions of sufficient protection as to the safe transit of the flow from the infected phone to the final destination server responsible for the stable storage of data,” the judge underlined. The records therefore remain of the Palamara talks, captured in May 2019, which have put many of his former colleagues in trouble. Including those relating to the dinner at the Champagne hotel which overshadowed negotiations on the top prosecutors. The prosecutors of Perugia – who in the meantime have acquired the spontaneous declarations of Centofanti – have always claimed the usability of wiretapping. “The judge confirmed our position after a very long discussion” underlined the chief prosecutor Raffaele Cantone, owner of the file with the substitutes Gemma Miliani and Mario Formisano. “We take note of the judge’s decision and await the results of the definitive investigations by the competent prosecutor of Florence” Palamara’s comment on the decision of the judge. “In any case, we will have recourse to the competent bodies, both in the Supreme Court and possibly at the European Court,” he added.

“We have always been confident, we have always maintained that the interceptions had been carried out correctly”. Thus the chief prosecutor of Perugia, Raffaele Cantone, commented with the breaking latest news on the decision of the Gup Piercarlo Frabotta, to reject the request that the wiretapping on the former magistrate Luca Palamara, advanced by the defense during the preliminary hearing which sees him accused in Perugia. “We wanted everything to be done in the utmost transparency, we have never hidden anything”, continued the prosecutor, owner of the file, declaring himself satisfied with the decision of the judge, who “confirms our position”.
