The lawyer and honorary magistrate Massimiliano Marchetti

The lawyer Massimiliano Marchetti has won a competition and from Monday 13 December will be director at the Prosecutor of Gorizia. “I’d like to go back to Conegliano, when the rights of the honorary magistracy will be recognized”

CONEGLIANO. The office of the Justice of the Peace of Conegliano returns to have only an honorary magistrate. The coordinator, judge Massimiliano Marchetti, won a competition and from Monday 13 December will be director of the Gorizia Public Prosecutor’s Office. The City of the Cima, but also the entire territory of Coneglianese, Vittoriese and Pievigino, will have only one justice of the peace, Massimo Armellini, who had taken up service since 2019. A situation of “solitude”, which Marchetti himself had experienced, since 2016 to 2019. 57 years old, a lawyer from Trieste, Marchetti arrived in Conegliano in 2003 and in 2004 was appointed coordinator of the justices of the peace, a role he played with unanimous appreciation.

Only in six months will he be able to know if he will be able to return to serve in Conegliano, why?

“There is a long-standing question concerning the honorary judiciary. The European institutions have “accused” Italy for the treatment of the precarious judiciary. I would have liked to stay until the end of the mandate, but until the reform is made there will be a continuous bleeding of judges who will have other positions. The law does not provide for incompatibility. But only after my entry into the public administration will there be a decision by the Ministry on the opinion of the office heads who, if positive, will see my return. But not for six months. ‘

An assessment of your experience?

«I leave with death in my heart, it was almost twenty years of life. At the beginning we were five honorary judges, then three remained, in 2013 also absorbed the office of the justice of the peace we were increasingly reduced. From 2016 to 2019 I was alone, a really heavy period ».

You are also a lawyer, what gives you the most gratification?

«I privileged the public aspect over the private one, that is, I had more satisfaction in working for the community, even if as a lawyer I had my satisfaction. However, this also comes from the decision to go to a place where there is a need for staff, the shortages of staff are known to all. I hope to be useful also in the office where I will start working from Monday ».

What will you remember with pleasure from Conegliano?

“That’s a million dollar question. I married a vittoriese, I already knew this territory. My children have grown up a lot in the area. I will be left with the concreteness and effectiveness. Between Conegliano and Vittorio Veneto I see a spirit of positivity, the goals achieved for example for Prosecco, the many productive, industrial and cultural realities are due to a spirit of enterprise. Coming from Trieste, past the Tagliamento, arrived in Veneto, I also observed another type of landscape, of care in things, which has always struck me. The care that the inhabitants of Conegliano and Treviso have in their occupations ».

He will return to Conegliano anyway …

«I also have a background as a former Alpine officer and I appreciate the food and wine excellences of these places. I have to thank Conegliano. I remember when I also went to give lessons in schools, for example at the Turistico, to make known the reality of the Justices of the Peace, who are occasionally confused with the courts. Instead they are proximity judges ». –
