The Colombian Ministry of Health announced that it has filed a lawsuit against 21 Health Promotion Companies (EPS) for violating the right of access to health by not complying with the obligation to establish and maintain the technical reserves necessary to guarantee payment of health benefits. Health services.

The popular action lawsuit was presented before the Contentious Administrative Court of Bogotá by the legal director of the Ministry, Rodolfo Enrique Salas, who based the action on a report from the Superintendency of Health that revealed the non-compliance with technical reserves by the EPS during the year 2023, using information provided by the companies themselves .

According to the Ministry of Health, technical reserves are essential assets that provide security and liquidity to insurers., allowing them to pay their network of providers. These reserves must guarantee the resources of the Capitation Payment Unit (UPC), coming from the health contributions of Colombian citizens.

The lawsuit highlights that failure to comply with these technical reserves could have serious consequences.since the EPS could run out of resources to pay for health services, which would lead the Health Providing Institutions (IPS) to stop providing services, thus violating the collective right to access the public social security health service. .

In the demand for popular action, The Ministry of Health requests that the EPS take immediate measures to comply with the constitution and investment of technical reserves, in order to guarantee pending obligations and ensure the fundamental right to health of the Colombian population.
