Worker died in the company at Zanutta: one year to the employer

Four and a half years after the death of Daniele Zamuner, a 54-year-old worker from Portegrandi, hit by a wooden beam thrown at him by a machine while he was working at Zanutta, on January 24, 2018, the conviction for manslaughter arrived on Friday in Treviso. and for failure to comply with the security name of the owner of the Casier (Treviso) company, which specializes in furniture and building products.

Lucio Zanutta was sentenced to one year of imprisonment – suspended sentence – while Gianluca Zanutta, 48, from Carlino was acquitted.

Judge Francesco Sartorio also awarded a provisional amount exceeding half a million euros to the victim’s family.

Gianluca Zanutta was acquitted because he was the legal representative of the spa and was not considered the de facto employer of Zamuner, a hypothesis that the Prosecutor preferred instead.

The actual employer was precisely Lucio Zanutta, 81, from San Giorgio di Nogaro, who received the sentence. The prosecutor had asked for two years for both of them.

“We are satisfied with the acquittal of Gianluca Zanutta, we were able to prove that he was not the employer even in fact”, said Fabio Pinelli, lawyer of the entrepreneurs, together with Paolo Tabasso. “For the conviction of Lucio Zanutta we are waiting to read the reasons, but I can already say that we will present an appeal”.

Pending the civil trial, which will establish the overall compensation, the judge has meanwhile recognized a provisional provision to the family members: 150,000 euros for the wife, 100,000 euros for each of the two daughters, 75,000 euros for the father, 35,000 euros each for the brother and two sisters, and 25 thousand euros each to the two grandchildren.
