The decision was made by the judges of Chamber 6 of the National Criminal and Correctional Appeals Chamber, Magdalena Laíño, Ricardo Matías Pinto and Ignacio Rodríguez Varela, who also rescheduled the oral hearing date which was to take place this Tuesday. It was set for May 22 and will be mixed -that is, face-to-face and virtual- and took the Prosecutor’s Office, the complaint and the defense by surprise.

In their opinion to appeal against the lack of merit, judicial officials asked that the businessman be prosecuted with preventive detention for two crimes: “femicide”which provides for a sentence of life imprisonment, and “facilitation of narcotics and a place to use them”from 3 to 12 years in prison if it is free of charge.
Emmily’s death: the 10 keys to the case
♦ Emmily Rodrigues was 26 years old, a native of Brazil and had been living in Argentina since 2019. She studied Medicine and worked in an aesthetic clinic.
♦ On March 30, after having gone to dinner at a restaurant in Costanera Norte and a bar in Palermo, Emmily arrived at 3:21 in the morning at Sáenz Valiente’s apartment, on the sixth floor of Libertad 1542, in the Retiro neighborhood, from where he fell into the void at 9.21.
♦ In the building, she participated in a party together with the businessman and three other women: her friends Dafne Santana and Juliana Magalhaes Murao, and Lía Figueroa Alvez, a friend of the defendant.
♦ The defendant and the witnesses stated that there was alcohol and drugs at the party, such as cocaine, marijuana, and “tusi” and they said that Emmily would have suffered a “psychotic break.”
♦ The autopsy indicated that the young woman’s injuries were compatible with the fall from the sixth floor but that she did not have those typical of defense or resistance.
♦ A neighbor of the businessman said that she saw the young woman ask for “help and for the police” before falling off the balcony.
♦ The Prosecutor’s Office determined that the events occurred in a “sexualized environment” and condoms and erotic lingerie were found in the apartment.
♦ In another raid, three syringes were seized and one of them contained a liquid that has not yet been defined.
♦ In one of the 911 calls made by Sáenz Valiente, a woman is heard screaming in the background – presumably she was the victim – “Please (…) they pricked me! Please!”
♦ The toxicological study determined that Emmily’s body had traces of ingestion of various drugs and alcohol.
